Spamless.dev provides an email filtering and security platform that analyzes incoming emails through a multi-layer inspection pipeline. The Service filters spam, phishing, malware, and other unwanted content before delivery to your mail servers. Services include quarantine management, custom rules, reporting, and related administrative features made available through our web interface and API.

3. Account and Eligibility

You must be at least 18 years of age and have the legal authority to enter into these Terms to use our Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use of your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:

• Use the Service for any illegal, fraudulent, or unauthorized purpose
• Transmit malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems, networks, or other users' accounts

5. Service Level and Availability

We strive to maintain high availability of our Service but do not guarantee uninterrupted access. The Service may be subject to planned maintenance, updates, and unplanned outages. We are not liable for any damages resulting from Service unavailability. Enterprise plans may include specific SLA commitments as defined in separate agreements.

6. Intellectual Property

The Service, including its software, design, logos, documentation, and all related intellectual property, is owned by us or our licensors. You receive no ownership rights beyond the limited license to use the Service as permitted by these Terms. You may not copy, modify, distribute, sell, or create derivative works of our Service without our prior written consent.

By using the Service, you acknowledge that we process email content and metadata as necessary to provide the filtering and security functionality. You represent that you have the legal right to process such data through our Service and that you comply with applicable data protection laws.

8. Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied. We disclaim all warranties including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities, even if we have been advised of the possibility of such damages. Our total liability for any claims arising from these Terms or the Service shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless Spamless.dev, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

You may terminate your use of the Service at any time by ceasing use and closing your account. We may suspend or terminate your access immediately, without prior notice, for breach of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall survive.

11. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Service.
